Privacy policy

This page contains information on how Trimarco Fabio (hereinafter referred to as “Data Controller”) processes the personal data of users/customers, collected through the Website www.fabiotbarbiere.com (hereinafter “Site”) and/or through other tools (e.g. via social media, email, cookies, etc.). This policy does not concern personal data that are collected from other sites that may be consulted by the user through links contained on the Site.
The purpose of this document is to provide information to the user/customer about the ways in which their data is collected, the purposes for which they are collected, the legal basis that legitimizes their treatment, for how long they are treated and the nature of their treatment.
This information has been prepared pursuant to Italian Legislative Decree no. 196/2003, Code regarding the protection of personal data, and pursuant to EU Regulation no. 2016/679 (GDPR), concerning the protection of individuals with regard to the processing of personal data as well as the free movement of such data, as amended by Italian Legislative Decree n. 101/2018.

Collected data

The Data Controller collects various types of personal data from the user/customer for the purposes described later in this Policy, including:

  • User/customer data provided by the same using the contact methods on the Site;
  • Personal data that may be contained in communications sent by the user/customer, for example to report a problem or to forward special requests, problems or observations relating to the Site or its contents;
  • Other personal data that the user/customer decides to share voluntarily, for example by e-mail or chat;
  • Information on how the user/customer’s device has interacted with the Site;
  • Information is also collected regarding the use and navigation of the user/customer on the Site. The data collected could be the following:
    • the internet protocol address IP (in anonymous form);
    • user location (approximate);
    • type of browser and parameters of the device used to connect to the Site;
    • date and time of visit to the Site;
    • web page of origin of the visitor (referral) and exit;
    • possibly the number of clicks;
    • other parameters relating to the operating system and computer environment of the user/customer on the Site.

      The above information is processed automatically and collected in an exclusively aggregated form in order to verify the correct functioning of the Site and for security reasons. The collected data does not contain personal information and the random unique visitor identifier generated by the software cannot be used to identify any particular visitor. The data will not be shared with other organizations for marketing, market research or commercial purposes.

      For security purposes (spam filters, firewalls, virus detection), if the appropriate software judges the user’s activity as anomalous, some data such as the IP address will be acquired in full and could be used, in compliance with the laws in force on the matter, in order to block attempts to damage the Site itself or to cause damage to other users/customers, or in any case to counter harmful activities or activities constituting a crime. They are never used for the identification or profiling of the user/customer, but only for the purpose of protecting the Site and its users/customers.

  • Indirectly, personal data may be collected by the Data Controller through access to the sites of any commercial partners. When the user/customer makes a reservation on a site of a commercial partner, the latter transmits the customer’s data so that it can register the reservation.

Purpose of the collection and processing of personal data

The Data Controller collects and processes the data of its users/customers for the following purposes:

  • Contractual purpose: finalize the booking of a service. In particular, proceed to the pre-contractual phase and to the execution of the contract, as well as to undertake activities related to the contract itself. This happens when the user/customer makes a reservation for a service;
  • Purpose of legal obligations: to fulfill obligations established by regulations and by applicable national and supranational legislation;
  • Purpose of exercising rights: if necessary, to ascertain, exercise or defend the rights of the Data Controller in court;
  • Functioning purpose of the Site: the computer systems and software procedures used to operate the Site acquire, during their normal service, some personal data in the use of Internet communication protocols;
  • Customer assistance purposes: if requested by the user/customer through the channels provided by the Site or, in general, through e-mail, to provide assistance, information on products and/or services;
  • Statistical purposes: view the behavior of the site, for example the response times, in order to make improvements (for this purpose no personal data is acquired as it is suitably anonymized and minimized);
  • Purpose of preventing abuse and/or fraud: exclusively to prevent and/or identify any fraudulent activity or abuse in the use of the Site and therefore allows the Data Controller to protect himself in court.

Legal basis for the collection and processing of personal data

The legal bases used by the Data Controller to process user/customer data, according to the purposes indicated in the previous paragraph, are as follows:

  • Provision of the Service: the processing for this purpose is necessary in order to be able to provide the services and, therefore, for the execution of the contract. It is not mandatory to provide data for this purpose, but otherwise it will not be possible to provide any Service;
  • Legal obligations: the processing for this purpose is necessary in order to fulfill any legal obligations. When you provide personal data, they must be treated according to the applicable legislation, which could involve their conservation and communication to the Authorities for accounting, tax or other obligations;
  • Functioning of the Site: the processing for this purpose is based on the legitimate interest of the Data Controller in the correct functioning of the Site;
  • Customer Service: the processing for this purpose is based on the legitimate interest of the Data Controller to provide assistance, information on products and/or services and related booking methods;
  • Abuse/Fraud: the processing for this purpose is based on the legitimate interest of preventing and/or identifying any fraudulent activity or abuse in the use of the Site and therefore allowing for protection in court.

Mandatory or optional nature of the provision and processing of personal data

The user/customer has no obligation to provide his personal data. However, the provision of personal data is necessary for the Data Controller in order to be able to process the booking request, for the provision of other services at the request of the user/customer, or for the fulfillment of the obligations established by legislative or regulatory provisions. The refusal by the user/customer to provide the data necessary for the pursuit of the aforementioned purposes may make it impossible to process the request or to fulfill the obligations established by legislative or regulatory provisions. Failure to provide personal data may therefore constitute, in some cases, a legitimate and justified reason for non-processing of the reservation or non-provision of services.

The provision of additional personal data other than those required for the fulfillment of legal or contractual obligations and for the correct display of services with the necessary traffic data is instead optional and does not produce any effect on the use of the Site. The customer is informed at each stage whether the provision of personal data is necessary or optional by affixing a symbol (*) on the information requested or on the data necessary for booking a service.

Personal data recipients

The personal data collected by the Data Controller may be shared with the subjects indicated below (the “Recipients”):

  • Subjects who typically act as data processors, i.e.: people, companies or professional firms that provide assistance and advice to the Data Controller in accounting, administrative, legal, tax, financial and debt collection matters relating to the provision of the Services;
  • Subjects with whom it is necessary to interact for the provision of the Services (for example: hosting providers, platform providers for sending emails, etc.);
  • Subjects delegated to carry out technical maintenance activities (including maintenance of network equipment and electronic communication networks);
  • Persons authorized by the Data Controller to process data necessary to carry out activities strictly related to the provision of the Services, who are committed to confidentiality or have an adequate legal obligation of confidentiality;
  • Subjects, bodies or authorities to whom it is mandatory to communicate data for purposes of compliance, abuse or fraud, or by order of the authorities.

Storage period

The Personal Data processed for the purpose of Providing the Services will be kept by the Data Controller for the time strictly necessary for the aforementioned purpose. In any case, since these data are processed to provide services to the user/customer, the Data Controller may keep them for a longer period, in particular for what may be necessary in order to protect his interests from possible complaints relating to the services (10 years).

The data processed for the purpose of legal obligations will be kept for the period established by specific legal obligations or by the applicable legislation.

The navigation data collected, used for statistical analysis purposes, are kept for a maximum period of 180 days. After this period, the system will proceed with automatic elimination.

The data processed in order to prevent abuse/fraud will be kept for the time strictly necessary for the aforementioned purpose and therefore until the moment in which the Data Controller will be required to keep them for protection in court and/or to communicate it to the competent Authorities.

User/customer rights

The user/customer is the holder of the following rights which refer to his personal data:

  • Right to withdraw consent: the customer has the right to withdraw his consent to the processing of data not provided for mandatory purposes at any time;
  • Right of access, rectification and cancellation: the customer has the right to request access to any stored personal data and to obtain a copy, request the correction of any inaccurate data and in some cases request the cancellation of personal data;
  • Right to data portability: in certain cases, the customer has the right to receive all personal data provided in a structured format, commonly used and readable by an automatic device and also to request transmission to another holder, where it is technically possible;
  • Right to limitation of treatment: the customer has the right to obtain the limitation of the processing of personal data where:
    • Dispute the accuracy of the personal data until the Data Controller has taken appropriate measures to correct or verify the accuracy of the data;
    • The processing is unlawful but the user/customer does not want the data to be deleted;
    • The Data Controller no longer needs the personal data of the user/customer for the purposes of the processing and the customer requests the aforementioned data for the preparation, exercise or defense of legal claims;
    • The user/customer has objected to the processing on the basis of reasons of legitimate interest pending the assessment regarding the pre-eminent and legitimate reasons for the continuation of the processing;
    • In the event that personal data are subject to limitations in this sense, the Data Controller will only process them with the consent of the user/customer or for the preparation, exercise or defense of legal claims.
  • Right to contest the processing on the basis of reasons of legitimate interest: in the case of processing of the customer’s personal data on the basis of the legitimate interest of the Data Controller, the user / customer will have the right to oppose the processing. In the event of a dispute by the customer, the Data Controller is required to interrupt the processing except for the demonstration of the existence of pre-eminent legitimate reasons for the processing which prevail over the interests, rights and freedoms of the customer or the demonstration of the need to prepare and/or exercise legal actions;
  • Right to contest the processing for marketing purposes: in the case of processing of the customer’s personal data for marketing purposes, the customer will have the right to oppose the processing at any time.

These rights may be exercised by sending to the Data Controller, without formalities or, alternatively, using the model provided by the Guarantor for the Protection of Personal Data, an e-mail to the address indicated in the section “Data Controller and place of data processing”.
In case of violation of the law, the user/customer has the right to lodge a complaint with the Guarantor for the Protection of Personal Data, as the authority in charge of monitoring the treatment in Europe.

Fulfillments of the data controller

The Data Controller notifies the Guarantor of the processing of personal data which he intends to proceed, only if the treatment concerns:

  • genetic, biometric data and data indicating the geographical location of persons or objects via an electronic communications network;
  • data suitable for revealing the state of health and sexual life, processed for the purpose of assisted procreation, provision of health services via telematics relating to databases or the supply of goods, epidemiological surveys, detection of mental, infectious and diffusive diseases, HIV positivity, organ and tissue transplantation and monitoring of health expenditure;
  • data suitable for revealing sexual life or the psychic sphere, processed by non-profit associations, bodies and organizations, even if not recognized, of a political, philosophical, religious or trade union nature;
  • data processed with the aid of electronic tools aimed at defining the profile or personality of the interested party or at analyzing consumption habits and choices or at monitoring the use of electronic communication services with the exclusion of processing that is technically indispensable for providing the same services to users;
  • sensitive data recorded in databases for personnel selection purposes on behalf of third parties as well as sensitive data used for opinion polls, market research and other sample research;
  • data recorded in special databases managed with electronic tools and relating to the risk of economic solvency, the financial situation, the correct fulfillment of obligations, illicit or fraudulent conduct.

Data transfer to countries outside the EU

This Site does not share any data collected with services located outside the European Union area. The data collected for statistical analysis purposes, in addition to being suitably anonymous, are stored on a server in the European Union, accessible only by users authorized by the Data Controller.

Security of the data provided

The Data Controller attributes great importance to the security of all personal data relating to users/customers. It implements security measures to protect personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorized communication or access. To best protect the personal data of the user/customer outside the limits of its control, the devices of the users/customers must be protected (with updated antivirus systems) and the internet service provider must adopt adequate measures for the security of data transmission over the network (such as firewalls and anti-spam filters).
Although the Data Controller does its best to protect the personal data of the user/customer, it cannot guarantee that the personal data communicated to it will be 100% secure or that no data breaches will occur.
The user/customer accepts the implications connected to online negotiation and will not hold the Data Controller responsible, or the respective operators, for any data breaches unless this is due to his negligence.

Communications and Complaints

Written communications directed to the Data Controller and any complaints will be considered valid only if sent to the postal address, or e-mail addresses, indicated in the place of treatment (2nd paragraph of the Policy). The registration form, residence or domicile, telephone number or e-mail address to which communications followed up within ten working days. In more complex cases we will undertake to provide an initial response no later than fifteen days.
